I disagree. This thread is not about some immigration lawyer. This thread is about visa numbers wasted due to USCIS inefficiency. That's what the title of the thread says. Why do I or anybody else care about some immigration lawyer? Why is he/she relevant if its specifically proven with facts that there is no wastage of visa number. You continue to advertise the name of the immigration lawyer. The reason I say this is because in my experience immigration lawyers comment on these issues as if they have direct access to USCIS Director or god. Even after disproving the visa wastage theory with facts you still continue to over analyze immigration body shop instead of discussing the issue. I am just wondering, why would you that? Are you that immigration lawyer or employee of his law firm? Just curious.
It's a pity to be desperate. But it's requires supreme stupidity to achieve this kind of cynicism. No I am not "That Lawyer" or his employer.

What if the H4 candidate recieves H1 but decides not to start a job at all. What will be his/her status in that case? H4 or H1?

Someone left a red dot on post with message: " tells of your lack of ideas".
I never said that this is the only option left and we have to do this. This was one of the proposal / suggestion. We welcomed other suggestions too! What I wanted and I still want is to do something, I wanted to have a brain storming so that we can come up with some better positive idea. This is not new. We had similar hurdles when tried to request people to promote HR 5882 and other events.
Above note is a sign of complete loser. This type of people don't have guts to come up in front and express their views because they really don't have guts to do anything. I am not ashamed that I proposed flower campaign where there are other possibly better options available.
I still strongly believe that doing something is always better than cursing something who is trying to do something or doing nothing.
Seriously, its not illegal lobbies that we are more threatened by. Its our own people.

I was working on H1 till May 08 now I am working on EAD
What should I write in column 15.(Current Immigration Status) in I-765 form
When I was on H1 in 2007, during first time EAD appliaction I filled with H1B

Need help!!!
I'm in US on L1 with company A, company B filed for H1B in Apr'09, H1 is not yet approved, and my L1 is also expiring in Nov'09. Since I'm not sure if I will get H1 approved, I have applied for L1 extension with company A.
My question is:
1. What will happen if I get H1 approved before Oct'09? Will I have to leave Company A and start working for compay B (H1) from 1st Oct even when L1 extension is in process?
2. If L1 extension is approved before 1st Oct, will I be able to continue working for comapny A, even if my H1 is approved?
Basically I don't want to be out of status or do anything against visa rules.
Please guide me on this situation.

Last time when we had a conference call, we decided to post flyers about immigration voice in our local communities and also getting in touch with the local newspapers. Since everyone is back from the holidays now, lets have a conference call next Wednesday. Till then, please post as many flyers as possible to increase IV's awareness.

If we put the word H1B in the Visa Re-capturing bill, the bill would be doomed. As few have rightly pointed out, it would be taken out of context probably advertised and interpreted as increasing H1B visas.
If we put the words, eliminating per country limits, it would doomed. The CNN headlines would scream "Indians and Chinese are coming".
If we put any changes to the current requirements of I-485 filing, it would be interpreted as diluting the existing laws to import more cheap foreign workers faster. The anti-immigration forces would be all over it like a monkey on a cupcake.
If we keep it simple : Re-capturing unused visa numbers for Employment Based Categories for Foreign Born Professionals already employed in the US legally and in the queue for Permanent Residency, we have a high chance of success.
IV team please start the fund raising for re-capturing visa numbers. Thanks.

How many applications are pending for EB-3 (I). ?
Currently the tunnel is closed at the end for EB-3 :mad: and the only way out I see is for us EB-3 folks to dig through. No one cares about EB-3 I folks. That's the way I see it.

It is anticipated that the addition of unused FY-2005 Family numbers and the remaining AC21 numbers to the 140,000 annual minimum will result in an FY-2006 annual Employment limit of 152,000. This will mean an Employment per-country limit for FY-2006 of approximately 10,650.
To illustrate the effect of the reduced per-county limitation during FY-2006 on the oversubscribed countries, it should be noted that during FY-2005 India used approximately 47,175 Employment numbers.
If you plug this number into your analysis the result might be a couple of years of advance for your predictions.

you buy a house when you don't have your green card, reduced to a single income with a new born, what else is gonna happen? Go buy BMW 3 series if you don't have one. Go invest thousands of dollars in stocks and then cry how your stock portfolio got wiped out (stocks will recover but by that time you'll have sleep disorder). I'm sorry to hear abt your daughter though, its not your fault but everything else is.
During 2001-3 recession, the time when the valley was hardest hit, one of my friends was forced to go India and wanted to leave his car behind because he came in 2001 and left a year later. People think when they come to the US of A, they fulfilled their life's ambition, not realizing their temporary status and immediately start buying new expensive cars and living it up! In another thread, my recommendation has been to buy a house rather than keep worrying over prices to reach rock bottom, but not unless you are green with a dual income and plans to live long term. How can you pan to live long term without being a resident is something I don't understand..
